1. Who you are contracting with

These Terms & Conditions ("Terms") form a binding agreement between you and HookViral ("HookViral", "we", "us", or "our"), the provider of the HookViral website and AI-powered hook generation service (the "Service"). By creating an account, using, or continuing to access the Service, you agree to these Terms.

2. Eligibility & account

You must be of legal age in your jurisdiction to enter into this agreement, and if you use the Service on behalf of a company you confirm you have authority to bind it. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account, and you agree to provide accurate, current information.

3. The Service

HookViral provides AI-generated short-form hooks and related content suggestions for social platforms. We may improve, change, or discontinue parts of the Service at any time. We do not guarantee that the Service will be uninterrupted, error-free, or that outputs will always be accurate or fit for a particular purpose.

4. Acceptable use

You agree not to misuse the Service. You will not:

• use the Service for any unlawful, fraudulent, or deceptive purpose;
• send spam, harassment, hate speech, or content that infringes any third-party rights;
• attempt to interfere with security, probe, scan, scrape, or reverse engineer the Service;
• upload malware, or attempt to gain unauthorized access to any account or system;
• generate content that is illegal, sexually exploitative, defamatory, or designed to deceive (e.g. deepfakes, impersonation);
• use outputs for regulated professional advice (medical, legal, financial) without independent verification;
• resell, sublicense, or redistribute the Service or attempt to circumvent technical limits.

5. AI outputs & your content

You are responsible for the prompts you submit, for verifying accuracy of generated outputs, and for ensuring you have the rights necessary to use any input content. As between you and us, you retain rights to your inputs and to outputs you generate, subject to these Terms and applicable law. We may remove, restrict, or refuse outputs that violate these Terms or applicable policies, and we may suspend repeat offenders. If you believe content infringes your rights, contact us so we can review and act on valid takedown requests.

6. Intellectual property

The Service, including its software, design, branding, and documentation, is owned by HookViral and its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with your selected plan and these Terms.

7. Subscriptions, payments & taxes

Paid plans are billed on a recurring basis (e.g. monthly) and renew automatically until cancelled. You can cancel at any time from your account page; cancellation takes effect at the end of the current billing period and you keep premium access until then. Prices and applicable taxes are shown at checkout.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. See also our Refund Policy.

8. Suspension & termination

We may suspend or terminate your access if you materially breach these Terms, fail to pay, present a security or fraud risk, or repeatedly or seriously violate our policies. You may stop using the Service at any time. On termination, your right to use the Service ends; we may delete account data after a reasonable retention period.

9. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. AI outputs may be inaccurate or incomplete and are not a substitute for professional advice.

10. Liability

To the maximum extent permitted by law, HookViral will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenues, data, or goodwill. Our aggregate liability for any claim arising out of or relating to the Service will not exceed the amounts you paid us in the 12 months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law (such as for fraud, death, or personal injury caused by negligence).

11. Indemnity

You agree to indemnify and hold HookViral harmless from claims arising out of your content, your use of the Service in violation of these Terms, or your violation of applicable law or third-party rights.

12. Changes to these Terms

We may update these Terms from time to time. If changes are material, we will notify you by reasonable means (e.g. in-app notice or email). Continued use of the Service after changes take effect constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the jurisdiction in which HookViral is established, without regard to conflict-of-law rules. Disputes will be submitted to the competent courts of that jurisdiction, unless mandatory law provides otherwise.
